RESOLUTION DENYING A SUBDIVISION WAIVER
FOR 7300 UPTON AVENUE
WHEREAS, an application has been filed with the City of Richfield which requests
approval of a subdivision waiver for the division of certain parcels of land located at 7300
Upton Avenue, legally described as:
Lot 1, except the North 20 feet thereof, Block 1, Penn Lake Terrace 2nd Addition,
Hennepin County, Minnesota
WHEREAS, the City has fully considered the request for approval for the
subdivision waiver; and
WHEREAS, the City Council finds that the proposed subdivision does not comply
with City Code requirements as follows:
1. The minimum lot depth requirement of 100-feet is not met (Subsection
514.11, Subd. 2). The proposed lot has a depth of 85-feet.
2. The minimum building setbacks are not met in any of the proposals
the applicant has submitted (Subsection 514.13, Subd. 2). The
minimum required setbacks are as follows: front - 30-feet, rear - 25-
feet, side - 5-feet.
3. The required driveway setback is not met in any of the proposals.
Driveways are required to be set back a minimum of 30-feet from an
intersection as measured from the point of intersection of the two
curbs (Subsection 514.05, Subd. 6e(iii)).
4. The most recent proposal, submitted to the City on September 29,
2008, exceeds allowable driveway width requirements (Subsection
514.05, Subd. 6e(i)). The proposed driveway measures 36-feet, while
the maximum allowable width is 22-feet.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Richfield, Minnesota, as follows:
A waiver for the subdivision of the Subject Property legally described above is
hereby denied.
Adopted by the City Council of the City of Richfield, Minnesota this 14th day of
October, 2008.
