RESOLUTION NO. 10078
RESOLUTION AUTHORIZING A SUBDIVISION WAIVER
FOR 7513 FREMONT AVENUE
WHEREAS, an application has been filed with the City of Richfield which requests
approval of a subdivision waiver for the division of certain parcels of land located at 7513
Fremont Avenue, legally described as:
Parcel A: Lots 21 and 22, Block 20, IRWIN SHORES, Hennepin County,
Minnesota
WHEREAS, the applicant proposes to divide the above-described Parcel A into two
parcels, legally described as:
Parcel One:
Minnesota.
Lot 21, Block 20, IRWIN SHORES, Hennepin County,
Parcel Two:
Minnesota.
Lot 22, Block 20, IRWIN SHORES, Hennepin County,
WHEREAS, the City has fully considered the request for approval for the
subdivision waiver; and
WHEREAS, the City Council finds that compliance with the City Code Section
500.05, Subdivision 1 would result in unnecessary hardship and that failure to comply
therewith will not interfere with the purposes of the platting regulations of Section 500.01.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Richfield, Minnesota, as follows:
1. A waiver for the subdivision of the Subject Property legally described above is
hereby granted;
2. This waiver is subject to the following condition:
. That following the approval of the necessary demolition permits, the existing breezeway
and garage located at 7513 Fremont Avenue are removed.
3. By the agreement of the property owner, the waiver is also subject to the
following conditions. A certificate of occupancy shall not be issued for Lot 21
until the following conditions are met:
. That garages are constructed on both Lots 21 and 22, Block 20, IRWIN
SHORES; and
. That trees in the rear yards of Lots 21 and 22, Block 20, IRWIN SHORES,
are trimmed to eliminate any hazard from damaged branches.
4. City staff is authorized and directed to take any action necessary to effectuate
this Resolution and to authorize the recording of conveyances complying with
the terms of this Resolution.
Adopted by the City Council of the City of Richfield, Minnesota this 25th day of
March,2008.
