2008-03 BILL NO. 2008-3 AN ORDINANCE RELATING TO PARKING AND ZONING REGULATIONS FOR CAR WASH, THERAPEUTIC MASSAGE AND AUTO DETAILING ESTABLISHMENTS; AMENDING SUBSECTIONS 1125.03, 1188.19 AND 1195.09 OF THE RICHFIELD CITY CODE THE CITY OF RICHFIELD DOES ORDAIN: Section 1. Subsection 1125.03, Subdivisions 1, 2 and 5 of the Richfield City Code are amended to read as follows: Subdivision 1. Off-street parking. For any establishment there shall be sufficient off-street area to provide for 10 automobiles waiting to be '."lashed. For this purpose the space of 20 foet by nine feet shall be provided for each car. Space for an additional ten cars shall be provided for cars which have been \Nashed and 'Nhich are waiting the m,~mers picking them up. There shaU also be off street parking for 15 employees' cars for each 'v\'ashing lane one parkinq space per emplovee of the larqest shift. stackino area for six vehicles per wash lane. plus two drvinq spaces per wash lane. Subd. 2. Permissible reduction of parking space. The number of parkin~ spaces for automobiles "A,aiting to be vvashed may be reduced to no less than 20, provided that the follm,ving conditions exist: (a) the revenue from automobile 'Nashing is likely to represeRt less than half of the total revenue of the business, on the basis of evideRGe presented to the council at the time that the permit is considered; (b) more than half of the revenue of the business is likely-te---.Be derived from the sale of gasoline and lubricants; (c) the business is located on a service drive where there is no development on the opposite side of the service drive; (d) the business does not abut upon any property zoned for single family or multi family use; (e) the business is located in 3 general commercial area; (f) the business abuts upon existing commercial off street parking are3S; (g) the car washing facilities are designed to provide for coiR- operated drive through operation; and (h) the business will not create 3ny unusual traffic or parkin~ problems in the vicinity Repealed. Subd. 5. ^dvertising. Each establishment shall have no more than one permanent detached display sign behveen the structure 3nd the street frontage line Repealed. Sec. 2. Subsection 1188.19, Subdivision 2 of the Richfield City Code is amended to read as follows: Subd. 2. Zoning compliance. A therapeutic massage enterprise may not be licensed if the location of such enterprise is not loc3ted in one of the gener31 commercial districts of the city must be located in an approved zoninq district and does not meet all zoning requirements. Sec. 3. Subsection 1195.09 of the Richfield City Code is amended to read as follows: 1195.09. Conditions governing issuance. The following conditions are imposed upon the granting of licenses under this Section: (a) The site of the licenses activity s.hall abut and have access to an arterial roadway. (b) No mechanical car washing equipment shall be used in connection with the licensed activity. (c) No overnight outside storage of vehicles shall be permitted. (d) The site shall be adequately screened from adjacent residential properties. (e) The licensed activity shall not result in undue congestion on surrounding streets. (f) There shall be adequate parking spaces provided on the site for customers and employees as foIlO'.\'s: three offstroet parking spaces for each bay 'Nhere auto detailing takes place; one offstroet parking Sf'}a€8--feF every employee. The licensee shall instruct customers and employees not to park on surrounding streets Parkinq shall be provided in accordance with the requirements of the Zoninq Code. (g) The licensed activity must be conducted totally within the confines of the building. (h) There shall be no exterior storage or sales of equipment, materials or products. (i) The licensed activity shall not generate noise, dust, or odors which disturb or annoy occupants of adjacent residential properties. 0) There shall be no more than one curb cut per street which must be located at least 50 feet from any intersection. (k) Exterior lighting shall be designed and directed so as not to cast light on adjacent residential property. (I) The establishment may be open only between the hours of 7:00 a.m. and 7:00 p.m. (m) The premises shall be maintained in a state of good repair at all times and shall be kept free of litter, trash, debris and weeds. (n) Underground storage tanks shall be removed as required by the City. (0) Licenses shall be granted only to establishments located in the commercial districts of the city an approved zoninq district. (p) If the establishment is located in a C 1 district, it must be proposed as a replacement to an existing gasoline service station, service station store or public garage Repealed. Sec. 5.
