RESOLUTION NO. 8783
RESOLUTION FOR CONTESTED CASE HEARING
WHEREAS, Don Pablos, 980 West 78th Street, ("Licensee") holds an On-Sale
Intoxicating and Sunday Liquor License from the City of Richfield; and
WHEREAS, on July 16,1999, the City of Richfield public safety department
conducted a compliance check of the Licensee's establishment; and
WHEREAS, during the compliance check, an employee of the Licensee sold alcohol
to a minor in violation of state law and city ordinances; and
WHEREAS, the Licensee appeared before the Richfield City Council on October 11,
1999, denied the violation and requested a contest case hearing.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Richfield
as follows:
1. The Public Safety Director is authorized and directed to retain an independent
hearing examiner to preside over a contested case hearing concerning the proposed
disciplinary action against the Licensee's license.
2. The contested case hearing shall be conducted in accordance with Minnesota
Statutes, Sections 14.57 to 14.69.
3. The hearing examiner shall schedule a hearing date that is mutually convenient to
the Public Safety Department and the Licensee, to be held within 60 days of the date
of this resolution. The hearing examiner shall notify the Public Safety Director and
the Licensee of the scheduled hearing date.
