RESOLUTION NO. 8761
RESOLUTION FOR APPROVING A CONDITIONAL USE PERMIT
7601 L YNDALE AVENUE SOUTH
WHEREAS, an application has been filed with the City of Richfield which
requests approval of a conditional use permit for a 160 units of senior housing and
office space on land generally located between 76th and 77th Streets and Lyndale and
Garfield Avenues.
WHEREAS, the City has fully considered the request for approval of the
conditional use permit.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Richfield, Minnesota, as follows:
1. A conditional use permit is issued for 160 units of senior housing and office
space, as described in City Council Letter No. 208, on the Subject Property
legally described above.,
2. The conditional use permit is subject to completing the following conditions:
. That a final landscape plan be submitted, including a tree protection plan,
and approved by the Community Development Director.
. That a sediment and erosion control plan be approved by the Public
Works Director.
. That a stormwater management plan be approved by the Public Works
Director.
. That the property be replatted.
. That a signage plan be submitted and approved by the Community
Development Director.
. That details of the noise wall removal and planting replacement be
approved by the Public Works Director.
. That design of the air conditioning unit covers be approved by the
Community Development Director.
. That a final development plan and conditional use permit be approved for
Phase III of the development.
. That a traffic study be completed regarding the impact of the Garfield
Avenue townhomes.
. That this resolution be recorded with the County, pursuant to Minnesota
Statutes Section 462.36, Subdivision 1.
3. The conditional use permit shall remain in effect for so long as conditions
regulating it are observed, and the conditional use permit shall expire if
.
normal operation of the use'has been discontinued for 12 or more months, as
required by the Zoning Ordi'riance, Section 546.05, Subd. 9.
Adopted by the City Council ofthe City of Richfield, Minnesota this 13th day of
