RESOLUTION NO. 9114
RESOLUTION AUTHORIZING AND DIRECTING
THE CITY ATTORNEY CONCERNING PENDING LITIGATION
WHEREAS, the City is a defendant in the court case captioned Walser Auto Sales.
Inc. v. City of Richfield. et aI., Hennepin County District Court Case No. AP-00-11927; and
WHEREAS, the Minnesota Court of Appeals has rendered a decision in the case
adverse to the City's interests; and
WHEREAS, the City Council believes the Court of Appeals decision to be
erroneous.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Richfield, that the City Attorney is authorized and directed to petition the Minnesota
Supreme Court for review of the Minnesota Court of Appeals decision.
