07-9997r RESOLUTION NO. 9997 RESOLUTION RELATING TO THE RICHFIELD PARKWAY AND 66TH STREET INTERSECTION PROJECT: ADOPTING SPECIAL ASSESSMENTS FOR THE PROJECT The City Council of the City of Richfield, Hennepin County (City) resolves: Section 1. Backqround. findinqs. 1.01. The City has duly ordered the construction of a public improvement project known as the Richfield Parkway and 66th Street Intersection Project (Project), in accordance with Minnesota Statutes, Chapter 429 (Act). The Project was ordered by Council Resolution, (No. 9855) of December 12, 2006 (Resolution). 1.02. The City Engineer has submitted to this Council a proposed assessment roll for the Project, attached as Exhibit A. 1.03. After proper notice duly given pursuant to the Act, the Council has met, heard and passed all objections to the proposed special assessments for the Project. Section 2. Assessment adopted. 2.01. In accordance with Minnesota Statutes, Section 429.061, the proposed assessment roll is accepted and adopted and constitutes a special assessment against the lands named therein, and each tract of land named therein included is found to be benefited by the proposed improvement in the amount of the assessment levied against it. ' 2.02. The assessment is payable in equal annual installments extending over a period of twenty years, the first of the installments to be payable on or before the first Monday in January, 2008. The installments will bear interest atthe rate of 5.75 percent per annum from the date of the adoption of this resolution. To the first installment will be added interest on the entire assessment from the date of this resolution until December 31, 2007. To each subsequent installment when due will be added interest for one year on all unpaid installments. 2.03. The owner of property so assessed may, at any time prior to the certification of the assessment to the county auditor, pay the whole of the assessment on the property, with interest accrued to the date of payment, to the city Finance Division, except that no interest will be charged if the entire assessment is paid within 30 days from the adoption of this resolution; and the owner may, at any time thereafter, pay to the city Finance Division the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which the payment is made. The payment must be made before November 15 or interest will be charged through December 31 of the next succeeding year. 2.04. The City Clerk is directed to forthwith transmit a certified duplicate of this assessment roll to the county auditor for extension on the property tax lists of the county. The assessments will be collected and paid over to the city in the same manner as other municipal taxes.
