HRA RESOLUTION NO. 834
RESOLUTION AUTHORIZING AND DIRECTING
THE HOUSING AND REDEVELOPMENT AUTHORITY'S ATTORNEY
CONCERNING PENDING LITIGATION
WHEREAS, the Housing and Redevelopment Authority in and for the City of
Richfield (HRA)is a defendant in the court case captioned Walser Auto Sales. Inc. v. City
of Richfield. et aI., Hennepin County District Court Case No. AP-00-11927; and
WHEREAS, the Minnesota Court of Appeals has rendered a decision in the case
adverse to the HRA's interests; and
WHEREAS, the HRA Board of Commissioners believes the Court of Appeals
decision to be erroneous; and
WHEREAS, the Court of Appeals decision raises various issues related to the
Contract for Private Redevelopment with Best Buy Co., Inc. and the project contemplated
by that Contract (the "Project").
NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of the
Housing and Redevelopment Authority in and for the City of Richfield, as follows:
1.
The HRA's attorney is authorized and directed to petition the Minnesota
Supreme Court for review of the Minnesota Court of Appeals decision.
2. The HRA executive director and HRA attorney are directed to investigate the
impact of the adverse court decision on the HRA and the Project and to
report back findings and recommendations to the HRA concerning all such
matters.
