12-10646r RESOLUTION NO. 10646 RESOLUTION GRANTING APPROVAL OF A SITE PLAN FOR 6328 PENN AVENUE WHEREAS, an application has been filed with the City of Richfield which requests approval of site plan for the parcel of land located at 6328 Penn Avenue, legally described as: Parcel 1: That part of the East 330 feet of the South 1/2 of the East 3/8 of the East 1/2 of the North 1/2 of the Northeast Quarter lying South of the North 396 feet thereof, except the South 180.5 feet thereof, Section 29, Township 28, Range 24, Hennepin County, Minnesota Together with Parcel 2: The non-exclusive driveway easement set forth in the Warranty Deed recorded as Document No. 1205403 in the office of the Registrar of Titles, Hennepin County, Minnesota WHEREAS, the requested site plan has been reviewed by the City Council and meets City requirements; and WHEREAS, the proposed site plan will adequately serve the purpose for which it is proposed and will not have an adverse effect upon the public safety or general welfare; and WHEREAS, the City has fully considered the request for approval for the site plan amendment; and NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Richfield, Minnesota, as follows: 1. That the proposed use of the existing building at the above address for 5,004 square feet of office space and 8,951 square feet of warehouse space, is hereby approved. 2. A revised site plan including parking stalls and aisles that meet current requirements must be submitted to and approved by the Community Development Director prior to the issuance of any permits. 3. The approved use requires 25 parking spaces to be provided either on-site or in a recorded agreement with the property located at 6344 Penn Avenue; 4. All parking spaces must be accessible year round. 5. All landscaping must be continuously maintained and not be unsightly in appearance or in a state of disrepair. 6. Obtain a Boulevard Feature Permit for any work that needs to be done within the boulevard. 7. The City will not issue the Certificate of Occupancy until these stipulations are met and/or an Escrow or Letter of Credit is provided for incomplete improvements. 8. Separate sign permits are required. 9. Trash may not be stored outside of the building. 10.This site plan approval shall expire one year from the date of approval unless a building permit has been obtained and construction of the project begun; or an extension has been requested and issued by the City Council, as required by Section 547.13, Subd. 9 of the City Code.
