06-9845r ~ESOLUTION NO. 9845 RESOLUTION DIRECTING CORRECTION .OF TECHNICAL ERRORS IN TRANSITORY ORDINANCE NO. 18.37 WHEREAS, on June 27, 2006, the City Council of the City of Richfield adopted Transitory Ordinance No. 18.37, relating to the vacation of certain street easements; and WHEREAS, the easements to be vacated by Transitory Ordinance No. 18.37 are those shown in the attached Exhibit A, which is a map taken from the staff report that was presented to the Council in connection with the proposed street vacation; and WHEREAS, the Hennepin County Examiner of Titles has determined that the legal descriptions used in Transitory Ordinance No. 18.37 to describe the easements to be vacated are ambiguous and require technical corrections; and WHEREAS, the intent of the City Council was to vacate the areas depicted in the attached Exhibit A; and WHEREAS, the City Council intends that the official record of the City accurately describe the streets vacated by Transitory Ordinance No. 18.37 and that the legal descriptions be satisfactory to the Hennepin County Examiner of Titles so that the Examiner may issue a directive to add the vacated portions of streets to the appropriate certificates of titles for abutting lands; and WHEREAS, the substitution of corrected legal descriptions, as may be approved by the Examiner of Titles, for those contained in Transitory Ordinance No. 18.37 as originally adopted will constitute a technical correction of the official city record and is not a substantive change in the areas vacated by that ordinance. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF RICHFIELD as follows: 1. The City Clerk is directed to correct the technical errors in Transitory Ordinance No. 18.37 by substituting for the legal descriptions set forth in Section 1 of Transitory Ordinance No. 18.37, as originally adopted, those legal descriptions as may be approved by the Examiner of Titles for the vacated areas as depicted in the attached Exhibit A. 2. The Mayor and City Clerk are authorized and directed to execute the corrected Transitory Ordinance, which shall bear the number 18.37. The City Clerk shall include a notation in the title of the corrected ordinance that the ordinance was corrected pursuant to this resolution. 3. The corrected Transitory Ordinance No. 18.37 shall constitute the official record of the City regarding the vacation of the streets depicted in the attached Exhibit A. 4. The City Clerk is directed to prepare a corrective Notice of Completion of Vacation Proceedings and to record the same in the Offices of the Hennepin County Recorder and Hennepin County Registrar of Titles.
