RESOLUTION NO. 9835
RESOLUTION APPROVING SUBDIVISION AGREEMENT
WITH RYAN COMPANIES US, INC.
WHEREAS, the Housing and Redevelopment Authority in and for the City of
Richfield, Minnesota (the "Authority") is undertaking a redevelopment project called Cedar
Point Commons, hereinafter called the "Project"; and
WHEREAS, the Project is included within The Richfield Redevelopment Project
Area, duly established by Resolution No. 8030, adopted on June 14, 1993 (the "Project
Area"); and
WHEREAS, on June 13, 2006 the City Council approved the Planned Unit
Development for Cedar Point Commons. The approved site plan eliminated 18th Avenue
and includes an extension of 63rd Street for access to the southern parking lot of Taft
Park; and
WHEREAS, on July 11, 2006 the City Council approved the Final Plat of Cedar
Point Commons; and
WHEREAS, as a condition of the approvals for the Project, Ryan is required to
construct certain street and trail improvements on the Park Property in order to provide
adequate traffic circulation for the project and to retain and improve access to the Park
Property; and
WHEREAS, the City and Ryan desire to agree to the design, construction and
timing of construction of the public improvements; and
WHEREAS, the City has reviewed the terms of a Proposed Agreement (the
"Subdivision Agreement") with Ryan, and has received the recommendation of City staff
regarding the terms of the Subdivision Agreement.
NOW, THEREFORE, BE IT RESOLVED by the City of Richfield, Minnesota as
follows:
1. The Subdivision Agreement is approved in substantially the form presented.
2. The Mayor and City Manager are authorized to execute the Subdivision
Agreement on behalf of the Council and to take all actions and do all things
that are reasonable necessary to the fulfillment of the City's obligations under
the Subdivision Agreement.
