1999 HRA Resolution 0725HRA RESOLUTION NO. 725 RESOLUTION AUTHORIZING EXECUTION OF A CERTIFICATE OF COMPLETION FOR MERIDIAN CROSSINGS, PHASE II WHEREAS, the Housing and Redevelopment Authority in and for the City of Richfield, Minnesota (HRA) entered into a Contract for Private Redevelopment (Contract) with Meridian Properties Real Estate Development L.L.C., a Minnesota limited liability company, d/b/a TOLD Development Company (Developer), dated November 6, 1995, pursuant to and in furtherance of the ILN Redevelopment Project heretofore adopted by the City and the Richfield Housing and Redevelopment Authority; and WHEREAS, the Contract obligated the Developer to construct certain improvements to the property identified in that Contract; and WHEREAS, Section 4.7 of the Contract required the HRA to furnish the Developer with a Certificate of Completion upon completion of the Phase II construction in accordance with Concept Plans; and WHEREAS, the Contract establishes the form for the Certificate of Completion in Exhibit B; and WHEREAS, staff has found the improvements to be in accordance with the terms of the Contract. NOW, THEREFORE, BE IT RESOLVED by the Housing and Redevelopment Authority in and for the City of Richfield that the Acting Executive Director and HRA Chair are directed to execute the Phase II Certificate of Completion and deliver same to the Developer. EXHIBIT B CERTIFICATE OF COMPLETION The undersigned hereby certifies that Meridian Properties Real Estate Development L.L.C., a Minnesota limited liability company, d/b/a TOLD Development Company has fully and completely complied with its obligations under Article IV of that document entitled "Contract for Private Development," dated November 6, 1995, between THE HOUSING AND REDEVELOPMENT AUTHORITY IN AND FOR THE CITY OF RICHFIELD and MERIDIAN PROPERTIES REAL ESTATE DEVELOPMENT L.L.C., a Minnesota limited liability company, d/b/a TOLD Development Company, with respect to construction of the Improvements located on the tract of land described in the attached Exhibit A in accordance with the requirements of such document and is released and forever discharged from its obligations to constructing the Improvements under such above-referenced Article on the above-referenced tract.
